(PRESENTERS: Megan McCall/Rob Smetana/Rozalynne Thompson/Bryan Archer) The purpose of this agenda item is to consider the proposed Service Plan for the Scenic Heights West Metropolitan District. A Service Plan has been reviewed by staff and changes made by the applicant related to that review. The proposed Service Plan was prepared in accordance with Chapter 91 of the Arvada City Code and the Model Service Plan. Requested deviations from the Model Service Plan are noted in the staff report. A copy of the proposed Service Plan is attached. A District is an independent unit of local government, separate and distinct from the City, and except as may otherwise be provided for by State or local law or its Service Plan, its activities are subject to review by the City only insofar as they may deviate in a material manner from the requirements of its Service Plan. It is intended that a District will provide part or all of the public improvements for the use and benefit of all anticipated inhabitants and taxpayers of the District. The City's objective in approving the Service Plan for the Districts is (among other things) to ensure that the cost burden of infrastructure in newly developed areas is placed upon those benefiting from such infrastructure improvements and to authorize the Districts to provide for the planning, design, acquisition, construction, installation, relocation and redevelopment of the Public Improvements from the proceeds of Debt to be issued by the Districts. The City team recommends that should City Council determine that the deviations from the Model Service Plan be appropriate for the district, that the City Council approve R26-068, A Resolution Approving the Proposed Service Plan for the Scenic Heights West Metropolitan District.
