PRESENTER:Rob Smetana This resolution is in the nature of a technical housekeeping measure, intended to ensure compliance with the "Municipal Annexation Act," Section 31-12-101 et seq. Section 31-12-110 of the Act states that "upon completion of the hearing [i.e., the public hearing on annexation], the governing body of the annexing municipality, by resolution, shall set forth its findings of fact and its conclusions based thereon with reference to the following matters: [those set forth in the attached resolution]." Section 31-12-111 goes on to state that, after the resolution (assuming the resolution determines that the requirements of Section 31-12-104 and 31-12-105 have been met, no election is required, etc.), the governing body may thereupon annex the area by ordinance. The requirements of Sections 31-12-104 and 31-12-105, as referenced in the resolution (and as asserted in the Petition for Annexation), are technical requirements of eligibility for annexation (e.g., 1/6 contiguity, etc.). Meeting those requirements does not mandate annexation of a given property, thus, in annexation proceedings, Council has the prerogative to adopt such a resolution (finding compliance with the technical requirements of Sections 31-12-104 and 31-12-105) and then reject the companion annexation ordinance (if, for example, it finds that such annexation is not in the best interests of the City). The Arvada team recommends that City Council approves R26-033, A Resolution Setting Forth Certain Findings of Fact and Conclusions as to the Annexation of Certain Land into the City of Arvada, Colorado, Martinez Annexation No. 1 and No. 2 FROM Jefferson County R -2 TO C ITY OF A RVADA R 6 ( R ESIDENTIAL, 6), a 1.17 Acre Parcel of Land Approximately Located at 5044 Carr St., AND A MENDING THE O FFICIAL Z ONING M APS OF THE C ITY OF A RVADA, C OLORADO.

What it covers: the record exactly as the official source publishes it — its identifiers (bill number, session, jurisdiction), its official title and long title, its official summary, its status, its sponsors in published order, every recorded action, every recorded vote, and the link to each official text version — assembled in a fixed canonical form described on the How this data works page.
The fingerprint does not cover our retrieval date (the “Data as of” stamp in the source line): re-fetching unchanged official content produces the same fingerprint, while any change to the official content changes it.
If you recompute the fingerprint from the official source and get a different value, one of us is out of date — please report it through the corrections log.
