PRESENTER: Katie Kurtz, Presiding Municipal Judge & Janelle Miller, Assistant City Attorney II The Colorado Supreme Court recently issued an opinion that has immediate impacts to sentencing in Arvada’s municipal court. In a combined opinion concerning cases In re People v. Camp, No. 24SA276, and In re People v. Simons, No. 24SA309, the Colorado Supreme Court ruled that when a municipal ordinance and state statute prohibit identical conduct, the municipal penalties for such conduct may not exceed the state penalties for that conduct. In light of this ruling, the City Attorney’s Office, in consultation with the Municipal Court and Police Department, has prepared an ordinance repealing and reenacting Chapter 62 of the Arvada City Code, which currently houses the majority of the City’s criminal offenses, to align the offenses and associated penalties with state law. The Arvada team recommends that the City Council approve CB26-003, An Ordinance Repealing and Reenacting Section 6-3, Reporting of Disorderly Conduct, of Article I, General, of Chapter 6, Alcoholic Beverages; Repealing Section 6-8, Illegal Possession or Consumption of Ethyl Alcohol by an Underage Person, of Article I, General, of Chapter 6, Alcoholic Beverages; Repealing Article II, Trial by Jury, of Chapter 58, Municipal Court; and Repealing and Reenacting Chapter 62, Offenses, of the Arvada City Code.
